{"id":362,"date":"2023-03-06T15:02:46","date_gmt":"2023-03-06T14:02:46","guid":{"rendered":"https:\/\/consultingprima.com\/?p=362"},"modified":"2023-03-11T14:50:56","modified_gmt":"2023-03-11T13:50:56","slug":"padi-ne-arbitrazh","status":"publish","type":"post","link":"https:\/\/consultingprima.com\/?p=362","title":{"rendered":"Padi n\u00eb Arbitrazh"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Arbitrazhi \u00ebsht\u00eb alternativ\u00eb e shpejt\u00eb dhe efikase n\u00eb zgjidhjen e kontesteve biznesore duke i anashkaluar k\u00ebshtu procedurat burokratike, p\u00ebrmes:<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">Zgjidhjen alternative t\u00eb mosmarr\u00ebveshjeve midis personave juridik;<\/li>\n<li style=\"text-align: justify;\">Zgjidhjen jasht\u00ebgjyq\u00ebsore, t\u00eb shpejt, t\u00eb leht\u00eb dhe me kosto t\u00eb ul\u00ebt t\u00eb kontesteve ekonomike;<\/li>\n<li style=\"text-align: justify;\">Nxjerrjen e vendimeve nga arbitri me kualifikime t\u00eb larta profesionale;<\/li>\n<li style=\"text-align: justify;\">Udh\u00ebzim n\u00eb p\u00ebrpilimin e klauzolave t\u00eb arbitrazhit;<\/li>\n<li style=\"text-align: justify;\">Konsulenc\u00eb lidhur me: fush\u00ebveprimin e arbitrazhit, marr\u00ebveshjen e arbitrazhit, padit\u00eb, rregullat e p\u00ebrgjitshme, provat, seanca dhe p\u00ebrfundimi;<\/li>\n<li style=\"text-align: justify;\">Mund\u00ebsi p\u00ebr arbitrazh t\u00eb p\u00ebrshpejtuar (marrjen e vendimit nga nj\u00eb arbit\u00ebr i vet\u00ebm m\u00eb p\u00eblqimin e t\u00eb dyja pal\u00ebve t\u00eb p\u00ebrfshira n\u00eb kontest); dhe<\/li>\n<li>Ndihm\u00eb n\u00eb njohjen dhe ekzekutimin e vendimeve t\u00eb tribunaleve t\u00eb huaja ose t\u00eb shteteve t\u00eb huaja.<\/li>\n<\/ul>\n<p><strong>Tribunali i P\u00ebrhersh\u00ebm i Abritrazhit (\u201cTPA\u201d),<\/strong> \u00ebsht\u00eb themeluar n\u00eb vitin 2011, i cili paraqet nj\u00eb institucion t\u00eb ristrukturuar, i cili ka evoluar nga gjykata e arbitrazhit pran\u00eb Od\u00ebs Ekonomike t\u00eb Kosov\u00ebs(\u201cOEK\u201d). Legjislacioni n\u00eb fuqi, p\u00ebrkat\u00ebsisht Ligji Nr. 2004\/7, \u201cP\u00ebr Od\u00ebn Ekonomike t\u00eb Kosov\u00ebs\u201d, autorizon n\u00eb m\u00ebnyr\u00eb shprehimore OEK-un q\u00eb t\u00eb ofroj\u00eb sh\u00ebrbime e arbitrimit.<\/p>\n<p style=\"text-align: justify;\">Baza Ligjore e themelimit t\u00eb TPA, Sipas dispozitave t\u00eb Ligjit Nr. 2004\/7 \u201cP\u00ebr Od\u00ebn Ekonomike t\u00eb Kosov\u00ebs\u201d, OEK ka autorizim publik t\u00eb themeloj\u00eb arbitrazhin e p\u00ebrhersh\u00ebm, i cili ka kompetenc\u00eb t\u00eb zgjidh mosmarr\u00ebveshjet nd\u00ebrmjet an\u00ebtar\u00ebve t\u00eb OEK dhe nd\u00ebrmjet\u00eb an\u00ebtar\u00ebve dhe personave t\u00eb tjer\u00eb juridik dhe fizik. Po ashtu, rregullat institucionale t\u00eb Arbitrazhit jan\u00eb hartuar n\u00eb pajtim me dispozitat e Ligjit Nr.02\/L-075 \u201cP\u00ebr Arbitrazhin.<\/p>\n<p style=\"text-align: justify;\"><strong>Rregullat e Arbitrazhit<\/strong>, Rregullat n\u00eb fuqi, t\u00eb cilat kan\u00eb shfuqizuar rregullat paraprake t\u00eb vitit 1999, jan\u00eb miratuar m\u00eb 24 Korrik t\u00eb vitit 2011. K\u00ebto rregulla jan\u00eb hartuar duke u bazuar n\u00eb rregullat e mir\u00ebnjohura t\u00eb arbitrazheve institucionale dhe ad hoc. K\u00ebto rregulla t\u00eb procedur\u00ebs aplikohen me automatiz\u00ebm n\u00ebse nj\u00eb marr\u00ebveshje e arbitrazhit e referon Kosov\u00ebn si vend i arbitrazhit, p\u00ebrjashtimisht situatave kur pal\u00ebt me marr\u00ebveshje u jan\u00eb referuar rregullave t\u00eb tjera apo rregullave t\u00eb institucioneve t\u00eb tjera. Kapitulli i fundit i k\u00ebtyre rregullave rregullon procedur\u00ebn e p\u00ebrshpejtuar, procedur\u00eb e cila ndiqet p\u00ebr secilin kontest vlera e t\u00eb cilit \u00ebsht\u00eb n\u00ebn 100,000.00 EUR.<\/p>\n<p style=\"text-align: justify;\"><strong>P\u00ebrpar\u00ebsit e Arbitrazhit,<\/strong> Arbitrazhi \u00ebsht\u00eb nj\u00eb nga m\u00ebnyrat alternative dhe efikase t\u00eb zgjidhjes s\u00eb kontesteve. Bizneset dhe jo vet\u00ebm, jan\u00eb t\u00eb interesuara n\u00eb zgjedhjen e shpejt\u00eb dhe jo-burokratike t\u00eb kontesteve.Arbitrazhi \u00ebsht\u00eb procedur\u00eb e cila dit\u00ebve t\u00eb tashme globalisht dominon n\u00eb kontestet n\u00eb mes t\u00eb bizneseve. Kontestet m\u00eb t\u00eb komplikuara dhe me vlera m\u00eb t\u00eb m\u00ebdha zgjidhen nga tribunalet e arbitrazheve n\u00ebp\u00ebr bot\u00eb.Procedura e arbitrazhit \u00ebsht\u00eb transparente dhe ofron mjete t\u00eb kontrollit t\u00eb procedur\u00ebs nga pal\u00ebt. Procedura \u00ebsht\u00eb e parapar\u00eb me rregullat e arbitrazhit, por koh\u00ebzgjatja, administrimi i provave vendoset n\u00eb pajtim t\u00eb dy pal\u00ebve n\u00eb kontest.Si p\u00ebrpar\u00ebsit\u00eb kryesore t\u00eb arbitrazhit ndaj gjykatave shtetrore, konsiderohen: (i) fleksibiliteti; (ii) efikasiteti n\u00eb koh\u00eb dhe shpenzime; (iii) plot\u00ebfuqishm\u00ebria e vendimit t\u00eb arbitrazhit dhe (iv) konfidencialiteti i procedur\u00ebs dhe vendimeve.<\/p>\n<p style=\"text-align: justify;\"><strong>Fush\u00ebveprimi i Arbitrazhit,<\/strong> N\u00eb baz\u00eb t\u00eb Ligjit Nr. 02\/L-75 \u201cP\u00ebr Arbitrazhin\u201d, t\u00eb gjitha mosmarr\u00ebveshjet q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me k\u00ebrkesa civile-juridike dhe ekonomike-juridike mund t\u2019i n\u00ebnshtrohen arbitrazhit, p\u00ebrve\u00e7 n\u00ebse \u00ebsht\u00eb e ndaluar me ligj. N\u00eb nd\u00ebrlidhje me Ligjin Nr. 03\/L-006 \u201cP\u00ebr Procedur\u00ebs Kontestimore\u201d, kontestet ku gjykatat shterore kan\u00eb kompetenc\u00eb ekskluzive l\u00ebndore dhe territoriale jan\u00eb: (i) kontestet nga marr\u00ebdh\u00ebniet familjare; (ii) kontestet nga sendet e paluajtshme; (iii) kontestet e falimentimit dhe (iv) kontestet lidhur me mjetet e fluturimit. Andaj, nuk paraqitet ndonj\u00eb penges\u00eb ligjore q\u00eb kontestet midis kompanive t\u00eb sigurimeve dhe mbajt\u00ebs\u00ebve t\u00eb polisave t\u00eb zgjidhen pran\u00eb abritrazhit dhe si pasoj\u00eb e k\u00ebsaj, kompanit\u00eb e sigurimeve mund t\u00eb kontraktojn\u00eb arbitrazhin si forum p\u00ebr zgjidhjen e mosmarr\u00ebveshjeve lidhur me raportet e tyre kontraktore dhe jasht\u00eb-kontraktore.<br \/><strong><br \/>Marr\u00ebveshja e arbitrazhit, <\/strong>Marr\u00ebveshja e arbitrazhit lidhet n\u00eb form\u00eb t\u00eb shkruar. Kushti konsiderohet se \u00ebsht\u00eb p\u00ebrmbushur edhe n\u00ebse lidhja e marr\u00ebveshjes s\u00eb arbitrazhit dokumentohet n\u00eb form\u00eb t\u00eb k\u00ebmbimit t\u00eb letrave, telefaksit, telegramit ose m\u00ebnyrave t\u00eb tjera t\u00eb telekomunikimit ose komunikimit elektronik, n\u00eb form\u00eb t\u00eb konosmanit, n\u00ebse konosmani p\u00ebrmban shprehimisht nj\u00eb klauzol\u00eb t\u00eb arbitrazhit, ose n\u00eb rast t\u00eb paraqitjes s\u00eb padis\u00eb dhe t\u00eb p\u00ebrgjigjes n\u00eb padi, n\u00eb kuad\u00ebr t\u00eb s\u00eb cil\u00ebs nj\u00ebra pal\u00eb pretendon se ekziston nj\u00eb marr\u00ebveshje arbitrazhi dhe pala tjet\u00ebr nuk e konteston k\u00ebt\u00eb. N\u00ebse nj\u00eb konsumator \u00ebsht\u00eb pal\u00eb n\u00eb marr\u00ebveshjen e arbitrazhit, marr\u00ebveshja e arbitrazhit konsiderohet t\u00eb jet\u00eb lidhur n\u00eb form\u00ebn e shkruar vet\u00ebm n\u00ebse t\u00eb gjitha pal\u00ebt n\u00eb marr\u00ebveshjen e arbitrazhit e n\u00ebnshkruajn\u00eb personalisht dokumentin q\u00eb p\u00ebrmban klauzol\u00ebn e arbitrazhit. N\u00ebnshkrimi i cekur n\u00eb k\u00ebt\u00eb paragraf mund t\u00eb z\u00ebvend\u00ebsohet me n\u00ebnshkrimin elektronik n\u00eb p\u00ebrputhje me legjislacionin p\u00ebrkat\u00ebs p\u00ebr n\u00ebnshkrimet elektronike.
