{"id":302,"date":"2023-03-06T11:47:37","date_gmt":"2023-03-06T10:47:37","guid":{"rendered":"https:\/\/consultingprima.com\/?p=302"},"modified":"2023-03-11T15:01:02","modified_gmt":"2023-03-11T14:01:02","slug":"ankimimi-ne-proceduren-permbarimore","status":"publish","type":"post","link":"https:\/\/consultingprima.com\/?p=302","title":{"rendered":"Ankimimi n\u00eb Procedur\u00ebn P\u00ebrmbarimore"},"content":{"rendered":"<p style=\"text-align: justify;\">Mjetet e rregullta juridike n\u00eb procedur\u00ebn p\u00ebrmbarimore, t\u00eb ankimimit jan\u00eb: Prap\u00ebsimi dhe Ankesa.<\/p>\n<p style=\"text-align: justify;\"><strong>Shkaqet e prap\u00ebsimit, prap\u00ebsimi mund t\u00eb bazohen vet\u00ebm n\u00ebse: <\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">Dokumenti, n\u00eb baz\u00eb t\u00eb cilit \u00ebsht\u00eb marr vendimi p\u00ebrmbarues ose urdhri p\u00ebrmbarues, nuk ka titull ekzekutiv ose nuk ka tipare t\u00eb p\u00ebrmbarueshmeris\u00eb;<\/li>\n<li style=\"text-align: justify;\">Dokumenti n\u00eb baz\u00eb t\u00eb cilit \u00ebsht\u00eb marr vendimi p\u00ebrmbarues ose urdhri p\u00ebrmbarues \u00ebsht\u00eb prishur, anuluar, ndryshuar ose shfuqizuar n\u00eb nj\u00eb m\u00ebnyr\u00eb tjet\u00ebr, gjegj\u00ebsisht N\u00ebse n\u00eb ndonj\u00eb m\u00ebnyr\u00eb e ka humbur efektin e tij ose \u00ebsht\u00eb konkluduar se \u00ebsht\u00eb pa efekt juridik;<\/li>\n<li style=\"text-align: justify;\">Pal\u00ebt, p\u00ebrmes dokumentit publik ose dokumentit t\u00eb certifikuar n\u00eb pajtim me ligjin, t\u00eb hartuar pas krijimit t\u00eb dokumentit p\u00ebrmbarues, jan\u00eb pajtuar q\u00eb t\u00eb mos e K\u00ebrkoj\u00eb p\u00ebrmbarimin n\u00eb baz\u00eb t\u00eb dokumentit p\u00ebrmbarues p\u00ebr nj\u00eb periudh\u00eb kohore t\u00eb kufizuar ose p\u00ebrgjithmon\u00eb;<\/li>\n<li style=\"text-align: justify;\">Ka skaduar afati kohor brenda t\u00eb cilit, sipas ligjit, mund t\u00eb k\u00ebrkohet p\u00ebrmbarimi;<\/li>\n<li style=\"text-align: justify;\">P\u00ebrmbarimi \u00ebsht\u00eb caktuar p\u00ebr sendet t\u00eb cilat jan\u00eb t\u00eb p\u00ebrjashtuara nga p\u00ebrmbarimi i detyruesh\u00ebm dhe, si rezultat i k\u00ebtij p\u00ebrjashtimi, mund\u00ebsit p\u00ebr kryerjen e P\u00ebrmbarimit jan\u00eb t\u00eb kufizuara;<\/li>\n<li style=\"text-align: justify;\">Kreditori nuk \u00ebsht\u00eb i autorizuar t\u00eb k\u00ebrkoj\u00eb p\u00ebrmbarimin n\u00eb baz\u00eb t\u00eb dokumentit p\u00ebrmbarues, gjegj\u00ebsisht ai nuk \u00ebsht\u00eb i autorizuar t\u00eb k\u00ebrkoj\u00eb p\u00ebrmbarimin kund\u00ebr debitorit;<\/li>\n<li style=\"text-align: justify;\">Kushti i p\u00ebrcaktuar n\u00eb dokumentin p\u00ebrmbarues nuk \u00ebsht\u00eb p\u00ebrmbushur, p\u00ebrve\u00e7 n\u00ebse parashikohet ndryshe me ligj;<\/li>\n<li style=\"text-align: justify;\">Kredia \u00ebsht\u00eb shuar si rezultat i ndonj\u00eb fakti t\u00eb shfaqur n\u00eb kohen kur debitori me nuk ka mundur t\u00eb paraqes faktin e till\u00eb gjat\u00eb procedur\u00ebs nga e cila ka derivuar Vendimi, pas p\u00ebrmbylljes s\u00eb nj\u00eb ujdie gjyq\u00ebsore ose nj\u00eb ujdie administrative ose n\u00eb ndonj\u00eb m\u00ebnyr\u00eb tjet\u00ebr;<\/li>\n<li style=\"text-align: justify;\">Realizimi i kredis\u00eb \u00ebsht\u00eb shtyr\u00eb, ndaluar, ndryshuar ose parandaluar n\u00eb ndonj\u00eb m\u00ebnyr\u00eb tjet\u00ebr, n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrhershme ose p\u00ebr nj\u00eb periudhe t\u00eb kufizuar kohore, si Rezultat i ndonj\u00eb ngjarje q\u00eb ka ndodhur n\u00eb kohen kur debitori m\u00eb nuk mund ta b\u00ebnte t\u00eb njohur n\u00eb procedur\u00eb n\u00eb t\u00eb cil\u00ebn \u00ebsht\u00eb nxjerr vendimi, respektivisht kredia \u00ebsht\u00eb shuar pas lidhjes s\u00eb nj\u00eb ujdie n\u00ebGjykat\u00eb ose n\u00eb organin administrativ;<\/li>\n<li style=\"text-align: justify;\">K\u00ebrkesa nga dokumenti p\u00ebrmbarues \u00ebsht\u00eb e mbrojtur me ndonj\u00eb statut t\u00eb kufizimeve; dhe<\/li>\n<li style=\"text-align: justify;\">Gjykata q\u00eb ka marr vendimin p\u00ebr p\u00ebrmbarim nuk \u00ebsht\u00eb kompetente;<br \/>p\u00ebrmbaruesi q\u00eb ka l\u00ebshuar urdhrin p\u00ebr p\u00ebrmbarim nuk \u00ebsht\u00eb kompetent.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Mjetet e jasht\u00ebzakonshme juridike:<\/strong> Nuk \u00ebsht\u00eb i lejuar revizioni dhe p\u00ebrs\u00ebritja e procedur\u00ebs n\u00eb procedur\u00ebn p\u00ebrmbarimore. Kthimi n\u00eb gjendjen e m\u00ebparshme \u00ebsht\u00eb i lejuar vet\u00ebm n\u00eb rastet e mos ruajtjes s\u00eb afateve p\u00ebr paraqitjen e prap\u00ebsimit dhe ankes\u00ebs kund\u00ebr vendimeve t\u00eb p\u00ebrmbaruesh\u00ebm p\u00ebr p\u00ebrmbarimin me dhun\u00eb.<\/p>\n<p style=\"text-align: justify;\">Prap\u00ebsimi kund\u00ebr vendimeve p\u00ebr p\u00ebrmbarim, Prap\u00ebsimi mund t\u00eb paraqitet vet\u00ebm kund\u00ebr vendimeve t\u00eb organit p\u00ebrmbarues me t\u00eb cilin p\u00ebrmbarimi \u00ebsht\u00eb i lejuar. Prap\u00ebsimi duhet t\u00eb paraqitet me shkrim organit p\u00ebrmbarues i cili e ka lejuar p\u00ebrmbarimin.<\/p>\n<p style=\"text-align: justify;\">Kur prap\u00ebsimi i paraqitet p\u00ebrmbaruesit privat, p\u00ebrmbaruesi privat obligohet q\u00eb n\u00eb afat prej tre (3) dit\u00ebsh pas pranimit t\u00eb p\u00ebrgjigjes n\u00eb prap\u00ebsim ose kalimit t\u00eb afatit p\u00ebr p\u00ebrgjigje, ta d\u00ebrgoj\u00eb l\u00ebnd\u00ebn n\u00eb gjykat\u00ebn kompetente.<\/p>\n<p style=\"text-align: justify;\"><strong>Baza p\u00ebr prap\u00ebsim duhet t\u00eb mb\u00ebshtetet me prova t\u00eb duhura.<\/strong> Provat p\u00ebr prap\u00ebsimin duhet t\u00eb dor\u00ebzohen me shkrim, p\u00ebrndryshe prap\u00ebsimi do t\u00eb refuzohet. Prap\u00ebsimi kund\u00ebr vendimit p\u00ebrmbarues ose urdhrit p\u00ebrmbarues mund t\u00eb paraqitet ekskluzivisht sipas dispozitave t\u00eb k\u00ebtij ligji. Prap\u00ebsimi do t\u00eb p\u00ebrmbaj t\u00eb dh\u00ebnat e vendimit p\u00ebrmbarimor kund\u00ebr t\u00eb cilit \u00ebsht\u00eb b\u00ebr\u00eb ankesa, arsyet e prap\u00ebsimit dhe n\u00ebnshkrimin e debitorit.
